Who Pays Damages After An Edmond Car Accident?
In Oklahoma, the individual determined to be liable for the accident will pay the damages incurred by the accident. This is because Oklahoma is a “fault” state regarding insurance.
Additionally, Oklahoma also operates out of the doctrine of modified comparative negligence (also known as contributory negligence).
As found under 23 OK Stat § 13 (2022), this statute dictates, “In all actions hereafter brought, whether arising before or after the effective date of this act, for negligence resulting in personal injuries or wrongful death, or injury to property, contributory negligence shall not bar a recovery, unless any negligence of the person so injured, damaged or killed, is of greater degree than any negligence of the person, firm or corporation causing such damage, or unless any negligence of the person so injured, damaged or killed, is of greater degree than the combined negligence of any persons, firms or corporations causing such damage.”
Essentially, that means that just because a person was negligent in a car accident, that does not mean they cannot receive damages. Damages are to be paid out proportionally to reflect how much an individual was at fault.
For instance, if a car accident victim was determined to be 25% at fault for the accident, then they would only be eligible to receive 75% of the total damages (to reflect the share of fault).
